The use of artificial intelligence in U.S. Customs has grown as Customs and Border Protection (CBP) has directed investments in that area.
To assist with image adjudication, CBP is investing in artificial intelligence and machine learning and developing anomaly detection algorithm capabilities.
The BEST Facilitation Act of 2023 will allow CBP to test and determine the feasibility of an additional solution to review non-intrusive inspection (NII) images as scan rates and the amount of NII images to be adjudicated increase.
Artificial Intelligence in U.S. Customs
The bill provides for CBP’s Office of Field Operations (OFO) to implement a pilot program. This program will allow trained, but non-law enforcement personnel to analyze images generated by NII systems. The personnel will be able to recommend to CBP officers whether the vehicle or cargo should be admitted or subjected to a secondary physical inspection.
In addition, the bill requires CBP to submit periodic reports to Congress. It must also provide information on the performance and impact of the imaging technician position on operations at ports of entry. This will allow Congress to monitor and evaluate the development of the pilot program.

At the same time, the U.S. government has made significant investments in artificial counterintelligence.
The term “artificial counterintelligence” refers to specific techniques and procedures.
